Ethical Guide Lines for Publications

Prim@ Facie, UFPB, is a four-monthly publication for a field of Law with interfaces focused on the Legal Sciences, Philosophy, History, Political Science and other related areas. It aims to promote debates on the problems of Brazil and the contemporary world with the participation of research from several universities and foreigners. The professional perspective available in constant dialogue with the temporal and political dimension of life in society. In this journal articles that constitute an original contribution will be published.

A) Ethical Obligations of the Editors:

  1. An editor must give impartial consideration to all manuscripts offered for publication, judging each by their merits without distinction of race, religion, nationality, sex, seniority or institutional affiliation of the author (s). However, an editor can take into account the relationships of a manuscript immediately under consideration with others previously or at the same time offered by the same author (s).
  2. An editor must consider the submitted manuscripts for publication with all reasonable speed.
  3. The sole responsibility of accepting or rejecting a manuscript rests with the editor. The responsible and prudent exercise of this duty normally requires the editor to seek the advice of the reviewers, chosen for their experience and good judgment, regarding the quality and reliability of the manuscripts sent for publication. Publishers should communicate openly with the authors and not provide comments under the guise of an anonymous review. However, manuscripts may be rejected without external review if the editors consider them inappropriate for the journal. Such rejections may be based on the fact that the manuscript does not conform to the scope of the journal, which is of current or sufficiently broad interest, which provides an adequate depth of content, which is written in acceptable language (Spanish, Portuguese or English) or other reasons.
  4. The publisher and staff members of the publisher should not disclose any information about a manuscript that is being considered by anyone other than those for whom professional advice is sought. (However, an editor requesting, or organizing in advance, the submission of manuscripts may need to reveal to a potential author that a relevant manuscript of another author has been received or is in preparation). After making a decision on a manuscript, the publisher and the publisher's personnel may disclose or publish the manuscript titles and the names of the authors of the works that have been accepted for publication, but no more than that unless obtained the permission of the author. If a decision has been made to reject a manuscript for ethical violations, the editor and the editor's staff may disclose the title of the manuscript and the names of the authors to other editors of the publications.
  5. An editor must respect the intellectual independence of the authors.
  6. The editorial responsibility and authority for any manuscript written by an editor of revista Prim@ Facie and sent to this journal must be delegated to another qualified person, such as another editor of that journal or a member of its Editorial Advisory Board. The editorial consideration of such manuscripts in any way or form would constitute a conflict of interest and, therefore, is inadmissible.
  7. If an editor receives convincing evidence that the main substance or conclusions of a report published in a publisher's journal are erroneous, the editor should facilitate the publication of an appropriate report pointing to the error and, if possible, correct The report can be written by the person who discovered the error or by an original author.
  8. Prima Facie Journal does not admit plagiarism. The publications follow the US National Science Foundation definition of plagiarism. The author (s) should not perform: textual or quasi-textual copy, or paraphrase very close to the text or results of other works. Similarly, they should not engage in self-plagiarism. Editors are obliged to report any plagiarism.

B) Ethical Obligations of the Authors

The authors are expected to adhere to the following ethical guidelines; infractions may result in the application of sanctions by the publisher (s), which include, among others, the suspension or revocation of publishing privileges.

The writer is committed to the veracity of the information provided in this consent term, especially considering that the textual contribution now submitted is original and unpublished, as well as that it is not being evaluated for publication by another journal;

  1. The Author (s) maintain (s) the copyright and grant the journal the right to first publication, the work being simultaneously licensed under the Creative Commons Attribution License which allows the sharing of the work with recognition of the authorship of the work and initial publication in this journal.
  2. The Author(s) declare that they are fully responsible for the entire content of the contribution they now submit to the Editorial Board of the Prim@ Facie.
  3. The Author (s) certifies that there is no conflict of interest that could interfere with the impartiality of the scientific works presented to the Editorial Board of the Prim@ Facie.
  4. The Author (s) must cite the publications considered to be influential to determine the nature of the presented work, being, therefore, responsible for the orientation of the reader(s) about the presented content.
  5. Except for a revision, one should minimize the indication of work that will not be mentioned in the reported survey. It is recommended that the author perform a bibliographic search to find and cite original publications that describe the work closely related to the topic addressed.
  6. When submitting a manuscript for publication, the author must identify the source of all the information used, except for those of common knowledge. Private information, such as conversations, correspondence or discussions with third parties should not be used or reported in the work without the explicit permission of the researcher from whom the information originated. 

In addition, information obtained in the course of confidential services deserves the same treatment of authorship.

Prim@ Facie does not admit plagiarism. The publications follow the US National Science Foundation definition of plagiarism. The author (s) must not perform: textual or almost textual copy, or paraphrase very close to the text or results of other works. Similarly, they should not engage in self-plagiarism.

The Author (s) who violate the ethical provisions that underlie the Revista Jurídica Prim@ Facie may incur sanctions by the consistent editor (s) in suspending or revoking the publication privileges.

 

C) Ethical Obligations of the Manuscript Reviewers

  1. To the extent that the revision of the manuscripts is an essential step in the publication process, and therefore in the operation of the scientific method, each scientist has the obligation to do a fair part of the review.
  2. An elected reviewer who feels inadequately qualified to judge the research reported in a manuscript should immediately return it to the editor.
  3. A reviewer (or arbitrator) of a manuscript must objectively judge the quality of the entire manuscript and the supporting information, taking due account of the maintenance of scientific and literary standards. A reviewer must respect the intellectual independence of the authors.
  4. A reviewer should be sensitive to the appearance of a conflict of interest when the manuscript under review is closely related to the work of the reviewer in progress or published. In case of doubt, the reviewer should return the manuscript quickly without review, notifying the editor of the conflict of interest or bias. Alternatively, the reviewer may wish to provide a signed review indicating the interest of the reviewer in the work, on the understanding that it may, at the discretion of the editor, be transmitted to the author.
  5. The confidentiality and anonymity of the external reviewers are expectations throughout the editorial review process in order to allow a sincere discussion and evaluation regarding the scientific content presented. Confidentiality of the manuscript: a reviewer must treat both the submitted manuscript and the data received from the journal and its report of arbitrators and related correspondence as confidential documents. These documents should not be disclosed or discussed with others, except, in special cases, when they are confidentially shared with people who can be called upon to obtain specific advice. In such cases, the identities of those to be consulted must be revealed to the editor in advance. Confidentiality of the reviewer and the review: Under no circumstances should the reviewer identify himself as the reviewer of a specific manuscript. In addition, the reviewer cannot disclose the content of the review sent to any individual or organization. This expectation of confidentiality and anonymity of the peer review extends beyond publication or rejection of the submitted manuscript.
  6. Reviewers should explain and support their judgments in an appropriate manner so that editors and authors can understand the basis of their comments.
  7. A reviewer should draw the editor's attention to any substantial similarity between the manuscript under consideration and any published document or any manuscript submitted concurrently to another journal.
  8. A reviewer must act promptly and send a report in a timely manner. In the event that a reviewer receives a manuscript at a time when circumstances preclude its immediate attention, the non-revised manuscript should be returned immediately to the editor. Alternatively, the reviewer can notify the editor of probable delays and propose a new review date.

Foco e Escopo

A revista eletrônica Prim@ Facie, UFPB, online, é um periódico quadrimestral para a área de Direito com interfaces voltadas para as Ciências Jurídicas, Filosofia, História, Ciência Política e demais áreas afins.

A Prim@ Facie tem como foco propiciar debates atualizados sobre problemas do Brasil e do mundo contemporâneo com a participação de pesquisadores de diversas universidades nacionais e estrangeiras. A perspectiva jurídica estará em constante diálogo com a dimensão temporal e política da vida em sociedade. Não é possível compreender o direito em separado dos interesses sociais e econômicos.

Nosso escopo é trazer à lume as discussões que promovam a compreensão aprofundada de temas como: crescimento econômico, desenvolvimento, criminalidade, direitos humanos, meio ambiente, globalização e trabalho, reconhecendo que as instituições públicas, mas igualmente as relações e os sujeitos privados, constituem pólos de produção normativa e de tensões de interesses que merecem ser objeto de investigação das Ciências Jurídicas. 

Para o atingimento dos seus fins acadêmico-científicos, a Prim@ Facie pode submeter seus números à organizadores que serão responsáveis pela seção Corpus (seção temática).
Padrão acadêmico a ser seguido:
- Publicar artigos em Português, Espanhol, Inglês, Alemão e Francês assinados por pesquisadores de alto nível;
- Publicar a revista com periodicidade regular;
- Ser pontual na publicação dos números;
- Publicar resumos, título e palavras-chave em Inglês ou outra língua estrangeira ao Português;
- Adotar e especificar as normas de publicação utilizadas;
- Identificar as afiliações dos autores e co-autores.

IV. Dos Pareceristas
Art. 12. São experts doutores com vinculação a IES ou Instituto de Pesquisa de natureza acadêmica, os quais emitem parecer científico sobre as publicações e são igualmente chamados de Avaliadores.
Art. 13. Cada avaliador recebe em total condição de anonimato as demandas de parecer e emite os pareceres no prazo acordado com cada editor dirigente responsável por aquele respectivo artigo.
Art. 14. Serão solicitados o mínimo de dois pareceres para cada artigo submetido em duplo cego.
[Revogado em 30/04/2017 por decisão do conselho de editores] Art. 15. Artigos CONVIDADOS não são submetidos ao sistema de pareceres e não podem ultrapassar o percentual de 25% dos artigos publicados por ano.

Estatuto da Revista Prim@ Facie

I. Da natureza da publicação
Art. 1º Prim@ Facie, ISSN 1678-2593, órgão do Programa de Pós-Graduação em Ciências Jurídicas, Universidade Federal da Paraíba, campus I, João Pessoa, Paraíba, é um periódico semestral de natureza científica flexível à dinâmica da pesquisa jurídica com vocação multidisciplinar conforme exigem as áreas de Direito Econômico e Direitos Humanos, sendo ela uma edição obrigatoriamente eletrônica, ou suplementarmente impressa.
Art. 2º A Prim@ Facie tem interesse numa ampla gama de temas jurídicos, históricos, políticos e contemporâneos, distribuindo os artigos nas seções editoriais definidas pela sua Comissão de Editoração.
Art. 3º A Prim@ Facie aceita submissões de artigos e trabalhos inéditos no Brasil e na rede mundial de computadores, para avaliação e publicação advindas de autores nas seguintes situações acadêmicas:
I –doutores de Instituições de Ensino Superior, brasileiras, ou estrangeiras.
II – doutorandos, desde que regularmente matriculados em Instituições de Ensino Superior brasileiras, ou estrangeiras enquanto participantes de uma colaboração com pelo menos um doutor, podendo este ser autor ou coautor.
III –mestres e mestrandos de Instituições de Ensino Superior brasileiras, enquanto participantes de uma colaboração com pelo menos um doutor, podendo este ser autor ou coautor.
§ 1º Não serão aceitas submissões com mais de três autores por cada artigo.
§ 2º Seis a cada dez autores por ano que publiquem artigos na revista devem ser afiliados a instituições externas ao Estado da Paraíba.
Art. 4º Os artigos e trabalhos submetidos à Prim@ Facie que não se enquadrarem nos requisitos do art. 3º deste Estatuto, ou estejam fora do padrão de cientificidade e de qualidade comum ao mundo universitário, poderão ser rejeitados e arquivados pelo editor geral, ou qualquer editor dirigente, sem prosseguimento da avaliação de mérito.

II.Dos Editores e do Conselho Editorial
Art. 5º Os Editores elaboram a composição do Conselho Editorial e estabelecem outras funções para o bom funcionamento da revista.
Art. 6º O Conselho Editorial faz a política editorial do periódico.
Art. 7º Os Editores devem recorrer aos conselheiros editoriais para aprovar cada edição sob a forma de duplo parecer cego entre pares, em pelo menos ¾ dos artigos publicados por ano, ficando SOMENTE ¼ do total de artigos publicados por ano para aprovação direta de artigos convidados.
Art.8º As decisões do Conselho Editorial acerca da publicação ou não de uma dada submissão são acadêmicas, autônomas e irrecorríveis, sendo tomadas em reuniões online previamente convocadas com a antecedência de cinco dias úteis, sendo válidas as convocações eletrônicas por e-mail.
Art. 9º Cada editor executivo recebe artigos para acompanhá-los e fazer a intermediação entre o Autor e pelo menos dois Avaliadores os quais agem em regime de parecer cego.

III. Do Editor Geral
Art. 10. É ele um editor dirigente, membro natural do Corpo de Editores, coordenando as atividades gerais da revista e executando as deliberações do Conselho Editorial.
Art. 11. Ao final de um mandato de dois anos, ou ainda no caso da interrupção deste por renúncia ou qualquer outro motivo, é feita a indicação de um nome da parte do corpo dirigente da revista, em comum acordo e em decisão final cabível exclusivamente ao Colegiado do PPGCJ.
Parágrafo único. Se não houver consenso na indicação de um novo editor geral para a revista no âmbito da Comissão de Editoração, cabe ao Colegiado do PPGCJ instaurar um processo eleitoral no âmbito do Programa, definindo as regras e procedimentos que lhe sejam adequados.

IV. Dos Pareceristas

Repudiamos toda forma de plágio, triando as submissões às quais uma análise acurada venha a demonstrar evidências de tal problema. O corpo editorial deste periódico encoraja autores, usuários e o público em geral a fazer reclamação concreta baseada em indícios, especialmente se o artigo já se encontra publicado neste periódico. Histórico do periódico

Lançada no segundo semestre de 2002, a Prim@Facie, Revista do PPGCJ, da UFPB, teve como editores-gerais: os professores doutores Fredys Orlando Sorto, Maria Áurea Baroni Cecato e Armando Albuquerque. Inicialmente de maneira interina, assumiu a revista a partir do ano 2014, o professor Dr. José Ernesto Pimentel. A partir de março de 2017, o prof. Dr. Fernando Joaquim Ferreira Maia seguiu como Editor-Gerente, sendo sucedido desde maio de 2018 pelo prof. Dr. Jailton Macena de Araújo.
