PERCEPÇÕES SOBRE GÊNERO E DIREITO: O QUE NÃO SE REGISTRA NOS AUTOS DOS PROCESSOS DE DESQUITE E DIVÓRCIO

Abstract

This article aims to discuss frustrated and / or interrupted marriage experiences through judicial separations. For this, written and oral sources were used, in order to reconstruct the past of the experience of a house, Joaquim and Albertina. The narratives constructed by the daily practices of these two individuals, record the affections of a marriage that experienced tensions and desires, in a space where the place of obligations is represented by the ritual of religious marriage and the ritual of civil marriage. The conflicts presented here bring an emblematic question for research, as they reveal fundamental aspects of daily life that are usually covered by habits and customs of daily life, therefore, the oral report, confronted with the legal source and social norms, helps us in understanding of changes that mark spaces through their transition rituals.Thus, in the face of so many transformations experienced in the family universe, women needed to reinvent themselves based on this set of changes that occurred in Brazil between the 1960s and the 1970s, which allowed women to question new values ​​and ideals, especially in the family. The establishment of roles in the family and in society that gradually changed, and reached women, who could see the breaking of bonds of subordination and dependence.
