RESISTÊNCIA E DIREITOS FUNDAMENTAIS NO CALDEIRÃO DA SANTA CRUZ DO DESERTO

Abstract

This article aims to analyze the community of Caldeirão da Santa Cruz do Deserto, based on reports obtained in bibliographic analysis, considering the political impact on this community in the First Republic. The methodology adopted is the bibliographic review and the approach methodology used is qualitative, considering the Right of Resistance as a guarantee of Fundamental Rights. Thomas Hobbes, Jean Jacques Rousseau and Henry David Thoreau were used as a reference for analyzing the events that occurred in the land of Blessed José Lourenço used in this work. We analyze the right of resistance, in one of its concepts in civil disobedience, about the events of the Caldeirão community in opposition to the government and unjust laws and, in effect, the permanence of this space of struggle in contemporary times. Among the results obtained, we can highlight the influence of the use of the Right of Resistance, although unknown by the community as a legal institute, in guaranteeing the Fundamental Rights essential to its existence and the attempt to maintain the Caldeirão and its creation objective; and how Civil Disobedience helped not only in transgressing the norms of the current system, but in promoting what are now established as democratic values.
