Abstract

The title of this article expresses the thesis that defends here: there's a new union structure in the consolidation process in Brazil. This transformation develops slowly since the rise of the new unionism in the late 1970s, with occasional changes in the corporatist structure inherited from Vargas, and take momentum from the Lula government when it reconfigures the relationship between State and Trade Unionism in Brazil after enactment of Law 11,648 / 2008, which promoted the legal recognition to unions. It defends the thesis that state corporatism derived from the 1940s added by neocorporatist elements intermediation of interest in the 1990s, and by a competition to pluralistic molds in the first decade of the XXI century, forming a combination of them, full of contradictions. Therefore, this article looks more closely at three very specific aspects of the union after 2008 to justify the thesis: the trade union registration, the category table and, related to these, the benchmarks of the representativeness of trade unions.
