Abstract

This article intends to analyze, through a theoretical-normative study, the phenomenon of “pejotização” (a neologism from the Portuguese acronym PJ, or Inc., in which company employees create their own individual micro-businesses) in the Brazilian legal system, highlighting the harmfulness of this practice to labor relations. For that purpose, the legal-deductive method was used, based on bibliographic and jurisprudential research, to defend the importance of applying the basic principles of Labor Law, more precisely the Primacy of Reality, to detect and unset this practice, ensuring rights to the worker. At the end, the “pejotização” - legal phenomenon whereby the employer makes their workers, private person, constitute themselves as a legal person and start to provide services through it - it is characterized as a fraud to the labor legislation, because it avoids the recognition the employment relationship - and the granting of labor and social security rights to the legal worker - since the service provider is a legal entity.
