Abstract

The present study verifies, in Brazil, how tattoo artist's copyright is protected from the moment the tattoo becomes part of the tattooed body, identifying what are the limitations and modulations to art. 24 of Law No. 9610/98. The creative process of tattooing is investigated between an artistic and technical perception regarding the subject autonomy in the Brazilian legal system, focusing on bodily freedom. The methodology, further developed by a case report, is bibliographic, empirical, pure, qualitative and exploratory. As results, it was verified that the tattoo has the potential to be protected by copyright when conceived in a creative and original way and that the freedom of the tattooed over his body behaves as a limited to the full exercise of the tattooer's copyright. It is concluded that the protection of the tattoo artist's copyright is total when the design is conceived in a non-human support and displayed in a showcase, however it is relative when applied or created directly on the skin of another person.
