Regulatory Perspectives Of The Practice Of Cashback As An Instrument To Drive Brazilian E-Commerce: Ex-Pos-Facto Analysis In The Context Of Covid-19

With the economic difficulties accentuated by the COVID-19 pandemic and fierce competition, there has been news of the adoption of cashback programs by various Brazilian sectors, especially in the E-commerce environment. In Brazil,
there is no specific legislation that regulates this program, giving rise to the use of different formats that imply less or more complex legal structures and relationships. From a qualitative approach of the Brazilian legislative scenario and
the methodology of bibliographic, documentary, jurisprudential research and news from newspapers and websites specialized in studies of market behavior, the results were used in a pure form, in order to expand the knowledge about a topic that is little or superficially addressed by the existing literature. The research is ex-post-facto, assuming the COVID-19 pandemic as a past fact and analyzing the previous and subsequent scenario in order to conclude on the regulatory
perspectives of cashback. The general objective of this work was to analyze the perspectives of regulation of the cashback program in Brasil, justifying its relevance in the conclusion that there is an apparent legislative gap, since the existing general norms, especially those of the Defense Code of the consumer, are perfectly applicable to the relationships arising from it.
