Institutional Violence Against Women In Criminal Justice

The article aims to synthesize the results of a research analysis of the institutional violence suffered by women in cases of sexual crimes, based on structural male chauvinism and the culture of rape, reflected in legal institutions posture. It will address the methods used by criminal justice when judging crimes against women, especially sexual crimes, in which the phenomenon of secondary revictimization occurs, since during the investigation and trial, the victim is subjected to reliving the suffering several times and is constantly questioned if the what you say is true or not. Through the deductive method, with a narrative bibliographic review, we seek to identify elements that make it possible to extract institutional violence in the procedural practice against women victims of sexual crimes. The research expectation is that elements linked to honor, socioeconomic origin and appearance of the victim are visualized to disqualify their suffering and testimony. The research results corroborate the hypothesis, pointing to the need to create mechanisms of education and awareness of law operators on sexual violence against women.
