The freedom in the modern state is backed by law, the fulfillment of what isprovided by law is that it provides direct security to citizens and gives confidence to the States. The institution of the national constitution is central in this discussion,given that this is the law made to last, functioning as a mechanism of checks and balances. This article addresses this issue through a theoretical and empiricalflyby, bringing to discuss issues and concepts fundamental to the understanding of contemporary democratic theory.Downloads
