ANALYSIS OF THE DIVERSITY OF LABOR AGREEMENTS IN PUBLIC EDUCATION

Abstract

The objective of this article is to discuss the types of labor agreements for teachers in the public education system, focusing on the duration of labor agreements, their rights as employees and their working hours. For this purpose, data was gathered from the RAIS (Annual Report on Social Information) data base, questionnaires were answered by 95 public school teachers in the state of São Paulo, and 17 of these teachers were interviewed. It was noted that many teachers were hired on a temporary basis (ACTs), in two types of situations. In the first situation, ACTs take classes for periods longer than a month and, in the other situation, teachers cover short leaves of absence. As to the total number of hours worked weekly, it was noted that there was a significant percentage of teachers working over 44 hours weekly. The article initially discusses the types of teaching agreement, aiming to analyze in detail the workings of the agreements, rights and obligations of teachers hired permanently (with tenure) and ACTs (hired on a temporary basis). Finally, the working hours of these teachers will be examined.
