Abstract

In the current context of productive restructuring, in which the loss of labor rights, the intensification of the labor rhythm and the incentive to individualism are observed, the gradual deterioration of labor relations is noted. The situation of excessive competition between workers and the enhancement of individual productivity favors the occurrence of moral harassment in the workplace. This article aims to identify the most common practices of moral harassment suffered by employees in the banking sector of Minas Gerais, based on the analysis of the jurisprudence of the Regional Labor Court of the 3rd Region, in the period between January and June 2018. In the present study bibliographic, documentary and survey research were used. The research reaffirmed the need to seek the accountability of the offending agent, with the intention of inhibiting such practices and, based on the Judiciary's power, assigning the potential to transform social reality.

Luciano Diniz, PhD, Centro Federal de Educação Tecnológica de Minas Gerais – CEFET/MG.

 

PhD in SOCIAL SCIENCES from the  Pontifícia Universidade Católica de São Paulo (2015), Master in PUBLIC LAW from the Pontifícia Universidade Católica de Minas Gerais Gerais (2008), has a post-graduate degree in BIOETHICS from the Pontifícia Universidade Católica de Minas Gerais  (2006) and a LAW DEGREE by the FUMEC University (2003). He is currently an adjunct professor III at Centro Federal de Educação Tecnológica de Minas Gerais- CEFET / MG. Researcher of the research groups CITIES - Interdisciplinary Research Center in Smart, Technological, Innovative, Entrepreneurial and Sustainable Cities (CEFET-MG); NEPUR - Center for Urban Studies and Research (PUC-SP) and LOGOS - Processes and Decision Systems in Organizational Arrangements (CEFET / MG). Vice-President of the Commission for the Defense of Historical and Cultural Heritage of OAB / MG.
