Abstract

This paper deals with the proposed release of outsourcing in all entrepreneurial activities, by means of overcoming the Labor Superior Court jurisprudence that proscribes it in the core business. The business invested focus in Congress and the Supreme Court. In this study, it is argued that the widespread release of outsourcing violates the Constitution of 1988. To this end, it analyses the social rights of workers as constitutional imposition, instead of conservative interpretations, the constitutionally protected employment model, the attempts to take out the Constitution rights workers, and the human dignity as a reference of the social values of work and free enterprise.
