Abstract

This article aims to analyze if collective bargaining clauses that derogate employees' legal protective provisions conform to the 1988 Brazilian Constitution and to the international treaties and conventions recognized in our legal order, despite favouring the employers in detriment to the justice of labor social relations. The analysis will be based on bibliographical applied research, with exploratory objectives. The hypothesis investigated is that the articles 611-A and 611-B of the Brazilian Labor Law, added by the Brazilian Labor Reform (Law n. 13.467/2017), must be interpreted and applied according to the 1988 Brazilian Constitution and to the international treaties and conventions recognized in our legal order, because they have binding authority as they protect fundamental rights that are intangible and irrevocable, so that they prevail over the employer's safety.

Doutora em Direito pela Universidade Federal de Minas Gerais (1989). Bacharel em Direito pela Universidade Federal do Pará (1984). Docente permanente do Programa de Pós-Graduação Stricto Sensu em Direito, Políticas Públicas e Desenvolvimento e do Curso de Graduação em Direito do Centro Universitário do Pará (CESUPA). Desembargadora do Tribunal Regional do Trabalho da 8ª Região, tendo exercido a presidência entre 2016 e 2018. Líder do grupo de pesquisas CNPQ "Emprego, Subemprego e Políticas Públicas na Amazônia" e vice-líder do grupo "MinAmazônia" (Mineração e Desenvolvimento Regional na Amazônia). É autora do livro A desconsideração da personalidade jurídica (disregard doctrine) e os grupos de empresas, bem como organizadora de várias obras e autora de artigos científicos que discutem temas ligados ao mercado de trabalho, desigualdade e aos Objetivos do Desenvolvimento Sustentável (ODS) na Amazônia.
