Quarantine With The Enemy: Analysis Of Domestic And Family Violence By The Rights Of Personality

The present study aims to present an overview about violence against women, as well as to analyze the context of violence that women are inserted due to the measure to contain the spread of the SARS-COV-2 virus, in contrast to the rights of the female personality. For the development of the study, it will be used the deductive method with support in the systematic review of the literature, and selected databases, such as Ebsco SSRN, Biblioteca Digital UniCesumar and Biblioteca do Senado Federal. Based on the Brazilian constitutional foundation of human dignity and, on the other hand, the existence of domestic and family violence, the present study seeks to answer the following question: to what extent are the rights of the female personality being affected by the 2020 pandemic? And a hypothesis arises as a preliminary understanding that the rights of the female personality, essential attributes of the woman, are affected by domestic and family violence in the same proportion that – in addition to reaching the physical and psychological integrity of the woman, altering the perception that the victim has of herself – worsens with social detachment (a necessary measure to contain the rapid spread of the COVID-19 disease) since family relationships intensify in this period.
