OUTSORCING REGULATORY REVIEW IN SELECTED COUNTRIES IN LATIN AMERICA

Abstract

This paper provides a regulatory review of outsourcing in six Latin America Countries: Argentina, Chile, Paraguay, Uruguay, Peru and Brazil. After a brief introduction, the second part of the paper provides information on the outsourcing growth in Latin America during the 1990s. The next part of the paper provides an overview of the main outsourcing legislation in Argentina, Chile, Paraguay, Uruguay and Peru. The third part of the paper deals with the state lack of legislation that characterizes the Brazilian juridical framework on outsourcing. The last part of the paper contains suggestions for new directions to support the elaboration of a Law Project that could improve outsourcing regulation, for instance, by forcing the adoption of solidary responsibility by contractors of outsourced services.
