Abstract

The objective of this article is to analyze the problem of building a legal framework for the Solidarity Economy in Brazil, including its incorporation into federal public policies between 2003 and 2016. The struggles for the construction of other social relations of production, in the challenge of taking place in confrontation with the hegemonic way of producing and working in capitalism, certainly passes, from the concrete point of view, through the contradictory and ambiguous disputes over the spaces of power of the State and its Law. The article is developed from documentary (legislation) and bibliographical research, and from the author's research and extension experiences, as part of the team of a University Incubator of Popular and Solidarity Economy, to reflect on legislative advances, their aporias and the perspectives that are drawn from Bill No. 6,606/2019 (No. 4,685/2012, in the previous numbering of the Chamber of Deputies). For this, emphasis is placed on the specific issue of legal discipline of legal formalization of so-called solidarity economic enterprises (EES).
