Comparative Study between the Brazilian Imperial State Council and the French State Council in Administrative Proceedings

Abstract

That time, administrative justice system in Brazil was organized according to the principle of separation between administrative and judicial authorities. In fact, it was a model based on doctrines and principles established in the France with the State Council created by Napoleon Bonaparte since 1799. This study aims to outline and compare main features of both structures, describing activities of the two agencies. We undertake a political analysis of powers considering specific circumstances of routine of the Brazilian State Council.
