Abstract

This article aims to analyze if collective bargaining clauses that derogate employees' legal protective provisions conform to the 1988 Brazilian Constitution and to the international treaties and conventions recognized in our legal order, despite favouring the employers in detriment to the justice of labor social relations. The analysis will be based on bibliographical applied research, with exploratory objectives. The hypothesis investigated is that the articles 611-A and 611-B of the Brazilian Labor Law, added by the Brazilian Labor Reform (Law n. 13.467/2017), must be interpreted and applied according to the 1988 Brazilian Constitution and to the international treaties and conventions recognized in our legal order, because they have binding authority as they protect fundamental rights that are intangible and irrevocable, so that they prevail over the employer's safety.
