The Transfer Of The State Biopower To Companies Through Labor Reform And Its Reflections On The Labor Environment

Abstract

The aim of this paper is dedicate to analyzing how the Labor Reform in Brazil transferred the biopower exercised over the life and health of workers, within the scope of the work environment, from the State to companies. Initially, based on the concepts shaped by Michel Foucault, for whom power is multicentric, the article is dedicated to analyzing how the power exercised in absolutist states, which was fixed on the power to make people die and let live, was gradually replaced by a biopower on the biological life of human beings, marked by the power to make people live and let them die, the way in which it came to be widely used by capitalism. Next, the article analyzes how the Labor Reform in Brazil promoted the transfer of biopower from the State to companies, and how they can use this power to control the health and safety of workers in the workplace. Using the deductive method and from a bibliographic and documentary research, exploratory, analytical-descriptive, it is concluded that reforms in the scope of labor relations are possible and, to a certain extent, necessary due to the technological advances experienced throughout society, but these must necessarily have as their main purpose the respect and guarantee of human dignity.
