The Protection Of The Fundamental Rights Of Indigenous Children And Adolescents: A Parallel Between The Universality Of Human Rights And Cultural Relativism

Abstract

The general objective of this work is to analyze the protection of the fundamental rights of indigenous children and adolescents, considering a parallel between the universality of human rights and cultural relativism. The specific objectives seek to understand the universality of human rights and the fundamental rights of children and adolescents, based on the theoretical framework of integral protection; as well as verify the parallel between the universality of human rights and cultural relativism in the context of the analysis of the protection of the fundamental rights of indigenous children and adolescents. The research problem asks: how are the fundamental rights of indigenous children and adolescents established, considering a parallel between the universality of human rights and cultural relativism? The initial hypothesis indicates that a universe of protection of the fundamental rights of indigenous children and adolescents should be considered, based on the theoretical framework of integral protection and the universality of human rights, substantiated in interculturality. However, it should be noted that the perspective of cultural diversity cannot naturalize discriminatory forms of protection for children. The method of approach used was the deductive and the monographic procedure, being developed from the techniques of documental and bibliographic research.
