Abstract

This study aimed to examine the philosophical conception present in the work of Sílvio Romero. Through the study of movements and ideals that influenced the author, as well as addressing the issues outlined by the same, there may be a more transparent view of the roots of his thoughts. His life and work were analyzed pan, then to develop the legal and philosophical aspects of his most outstanding work. The analysis of texts Romero was achieved based on the use of rhetoric and so-called proofs of persuasion: ethos, pathos and logos. So you can observe and understand the methods used by the author to persuade the target audience for their speeches. Thus, this study examined mainly Romero as a precursor of the modernization of law in Brazil through his "scientism" which eventually influences the Civil Code of 1916.
