O Direito Humano à Participação Política

Em desenvolvimentos recentes em filosofia política e legal, há uma tendência de endossar listas minimalistas de direitos humanos que não incluem um direito à participação política. Contra tais tendências, argumentarei que o direito à participação política, entendido como distinto de um direito à democracia, deveria ter um lugar mesmo em listas minimalistas. Além disso, defenderei a necessidade de estender o direito à participação política para incluir a participação não apenas em processos nacionais de governança, mas também nos processos internacionais e globais. O argumento será baseado em uma concepção cosmopolita de legitimidade política e em uma concepção política de direitos humanos que é normativamente ancorada na legitimidade. A afirmação central do meu artigo é que um direito à participação política é necessária – embora insuficiente – para a legitimidade política no âmbito global.
