Abstract

This is a study on the mediation of culture in the process of understanding and interpreting legal norms in determining their meaning and scope for their concrete application, based on the study of Hans-Georg Gadamer's work Truth and Method analyzes the role of culture in the legal hermeneutical procedure, both from the perspective of the interpreter and the recipient of the legal norm, where the jurist enters the game of interpretation of the norm, with the set of prejudices provided by tradition, having a cultural horizon that must merge with the horizon of the specific case to simultaneously produce an understanding and interpretation of the norm that allows the specific case to be resolved, through a creative interpretive solution that is manifested through language , which in turn is a cultural product that allows the understanding and expression of human thought in dialogue I go with other cultures even, so that culture is the stage, the horizon where the historical process of formation and application of the legal system takes place.

Juan Arcides Chirino Colina, Universidade do Estado do Amazonas

Advogado formado pela Universidade Central da Venezuela (1990). Especialização em Direito Processual pela mesma universidade. Procurador  Superior do Estado Delta Amacuro na Venezuela, funcionario do Poder Judiciário: Juiz Superior Acidentário do Tribunal Superior Civil do Segundo Circuito Judicial do Estado  Sucre, Juiz  de Primeira Instância do Circuito Judicial Criminal do Estado Sucre. Professor visitante em cursos de pós-graduação na Universidade de Margarita e professor de graduação e pós-graduação na Universidade Gran Mariscal de Ayacucho. Atualmente cursa mestrado em Direito Ambiental na Universidade do Estado do Amazonas. estudante estrangeiro Bolsista FAPEAM.

Possui graduação em Direito - Faculdades Integradas Cândido Mendes Ipanema (1991),Mestrado e Doutorado em Direito pela Universidade Estácio de Sá concluídos em 2005 e 2012, respectivamente. Pós-Doutor pela Universidade do Estado do Rio de Janeiro em Processo Civil (2013). Atualmente é Juiz Titular da 5ª Vara do Trabalho de Manaus - Tribunal Regional do Trabalho da 11ª Região. Coordenador do NUPEMEC/CEJUSC do Tribunal Regional do Trabalho da 11 Região. Professor do Programa de Pós-Graduação em Direito Ambiental da Universidade do Estado do Amazonas e da Especialização de Direito e Processo do Trabalho da UEA/AMATRA 11. Professor de Direito do Trabalho II e Processo do Trabalho na Faculdade Santa Tereza. Coordenador do Curso de Direito na Faculdade Metropolitana de Manaus - FAMETRO, unidade Leste
