Abstract

This article intends to examine the relationship between the advances in biological sciences as well as information technology and the fundamental right to social security applying a phenomenological-hermeneutic method. The aim is to investigate the current position of State as provider of right in the face of new technologies and their influence on the generation of new rights as a condition to the possibility of enhancing access to existing social security rights. The proposed solution aims to ensure mainstreaming legal sources through the (re)deployment of fundamental rights as a paradigm for regulating the access to social security once it does not take place on the top of the pyramid of the legal system, since it stands as a dimension of intermediation.
