Personal data protection and the contours of informational sel-determination

Currently, the exponential growth in the volume of data and information available on the network in the face of transformations arising from information and communication technologies has been perceived. This process has sharply modified, as the circulation of data and personal information have occurred, and the need for the creation of the General Data Protection Law to establish control over it remains. In this sense, this work aims to analyse the principle of informational self-determination as the basis of the protection of personal data in order to outline its meaning, scope, concept and criteria of effectiveness. For this, it seeks to examine fundamental aspects in the circulation of data and information today, as well as its regulation, with a focus on the main aspects of the General Data Protection Law, highlighting consent as a way to externalize the foundation of the informative self-determination. As a methodology, exploratory, bibliographic and documentary research will be adopted, with hermeneutics as a method of systematization to determine the meaning and scope of the expressions of law. Finally, it seeks to outline the meaning, scope, concept and criteria for the effectiveness of information altogether that makes possible the consequent construction of control policy under the circulation of data and personal information efficiently.
