Legal Protection of the Consumer in Default

Abstract

This article aims to analyze the legal protection of consumers in a default. For this, as an initial approach, mention will be state intervention in the economy to promote the equalization of material contracts consumerism, through contractual interventionism, a phenomenon that was raised along with the constitutionalization of private law and legal profusion of microsystems replacing the previously dominant legal monossistema in the Civil Code was the center of the legal system. It will promote the doctrinal classification of species of defaulting consumer, differentiating indebtedness of over-indebtedness, and, finally, be a legal analysis, doctrine and jurisprudence in Brazil with respect to protection of the consumer in default, addressing specific aspects.
