Direito e paradigmas: noções propedêuticas.

Abstract

These notes take into consideration and update a text published in 1984, which tried to apply to the legal theory the most relevant constructions of the contemporary philosophy of science. Until now the research objects of the jurists have remained unchanged, i.e. vinculated to the normativist paradigm. Should we abandon this paradigm, or would it be sounder just to complement it? The scientific opinion states that scientific paradigms are very complex both in the natural and in the social sciences. They can be found in every activity of our daily life. It is therefore adequate to re-consider today the basic ideas expressed in the book of 1983. Special attention is paid to the theories of Thomas Kuhn on scientific paradigms, always structuring recent research fields, as for the socio-environmental studies and the theory of human rights.
