Abstract

After noting that the WTO has not been able to modify its rules to strengthen the protection of the environment in the multilateral trading system, this article analyzes the reasons for this unaltered scene considering two different perspectives. It’s an article with the intention of alert jurists about the consequences (1) of simplistic approaches, (2) of the use of inconsistent solutions or methods of diagnostic for the problems and (3) of the needing of a critical attitude and a holistic viewpoint for a scholar who are studying the phenomena.
