Sistema Interamericano De Proteção Dos Diretos Humanos: Análise Da Efetividade No Brasil

The present scientific article was developed with research destined to the analysis of administrative or juridical measures promoted by the organs of the Inter-American System for the Protection of Human Rights. The methodology was consolidated in a descriptive research obtained through bibliographical sources, documents, as well as of statisticals data by public domain. The research problem of this work was based on the apparent remission of the Human Rights to a high abstract juridical skeleton, whose effectivity, whether national or international, suffers from practicality, in addition to the idea about the distortion in favor of evildoers in detriment of the expected protection to society. Throughout this article, the global, regional and national development of human rights, its consignment on the CRFB/88, legal typification, as well as the analysis of decisions of the Inter-American Court and recommendations of the Inter-American Commission impactful in the scope nacional, with the purpose to delineate the desired effectiveness. It is concluded that, although the system lacks the most adequate structure to receive demands from the countries belonging to them, it is clear that advances and achievements have been made towards the desired effectiveness of human rights in Brazil and other countries that make up the inter-American system.
