A VIOLAÇÃO DO DIREITO HUMANO À EDUCAÇÃO E A PROMOTORIA DE EDUCAÇÃO:

UM ESTUDO NA AMAZÔNIA AMAPAENSE (2015–2024)

Abstract

This article analyzes the recurring forms of state denial of the human right to education, based on data collected from 187 extrajudicial proceedings instituted by the Public Prosecutor's Office for the Defense of Education (PJDE) of the District of Macapá, located in the state of Amapá, Amazon region, Brazil, between 2015 and 2024. The study begins with the understanding of education as a fundamental social right, the implementation of which remains unequal in peripheral contexts. A qualitative approach is adopted, based on documentary analysis of the PJDE's public electronic proceedings, prioritizing the category "access" as a concrete expression of violations. The data reveal the existence of systematic patterns of exclusion related to the scarcity of vacancies, denial of enrollment, and omissions by government authorities, especially in vulnerable territories. It argues that such manifestations are not exceptions, but rather the reproduction of a state logic that excludes basic rights. The article reinforces the importance of strengthening the justice system, such as the Public Prosecutor's Office, to expand access to justice and the full exercise of citizenship.
