stable climate as a new kind of common heritage of humanity?

Given the context of the climate crisis and the conceptualization of climate stability as a common concern of humanity, this study examines the possibility of climate stability being recognized as a new type of common heritage of humanity (CHH) in the international legal system. Its objective is to analyze to what extent climate stability can be recognized as a new type of common heritage of humanity in three sections: (a) understanding the global climate system, (b) investigating the legal regime of existing common heritages of humanity, and (c) analyzing a new type of CHH in the international context: climate. It was found that it is possible to separate the static components of the planet, under the sovereign dominion of States, from the dynamic and fluid components that characterize climate, allowing for the recognition of climate stability as a common heritage of humanity in a hybrid system that brings together traditional characteristics of these legal goods and new characteristics inherent to climate. The specific objectives of the study were achieved, and the originality of the research lies in the structuring of the new elements that would integrate the common good "climate" if it is recognized internationally.
