Organized Crime: Origin, Development, Characteristics And Deficient State Combat

Abstract

The scale and complexity of organized crime stop state legal instruments from being sufficient to combat and prevent them. Organized crime, with some attendance, interacts with the State, usually taking advantage of state inefficiency and the corruption practice by several agents and public officer. The consequences resulting from the performance of organized crime are very injurious to the individual, society and the State, especially when the kind of action has the criminal participation from public agents and agencies. The research aims to analyze the source, development and characteristics from the organized crime, its relationship with the State and the effects resulting from its exercise.  The methodology used is inductive, through legal and doctrinal research. I concluded that the State, whether facing of its inefficiency or reason of the wrongful participation of part of its agents and public agency, ends up contributing to the ineffectiveness of the fight and to the perpetuation of organized crime.
