LAWFARE COMO MANOBRA DE GUERRA CONTRA A PROTEÇÃO JURÍDICA DOS MIGRANTES NO GOVERNO BOLSONARO:

O Autêntico “Brasil Recebe, mas Não Acolhe”.

Abstract

The present study aims to analyze how Brazil addressed the issue of migration and refuge for Venezuelans during Jair Bolsonaro's government. One of the central issues addressed concerns various anti-migration acts, whose primary objective is to delegitimize the rights of Venezuelans, often seen as enemies of the State. Additionally, the aim is to analyze and binding the phenomenon of lawfare to this context. The research method adopted is characterized as exploratory and descriptive, developed through a deductive method. Initially, the concept and origin of the phenomenon are presented. Then, various contradictory measures adopted by the government in the field of migration law are addressed. Subsequently, an analysis of lawfare is conducted in specific acts against Venezuelans, considering the ideological and political dimension of the government. In conclusion, it is found that Jair Bolsonaro adopted a contradictory position regarding the migration issue, drawing inspiration from Trump's anti-migration policy. This demonstrates that humanitarianism is selectively used, visibly employed for purposes of social control, aligned with political and ideological values. Thus, it is possible to establish a binding between this approach and the phenomenon of lawfare.
