Abstract

The problem that is the object of the article is the contrast between the hermeneutic procedure recommended by article 4 of the Law of introduction to the norms of Brazilian law (LINDB), which provides that in case of omission of the law, one must resort to analogy, customs and general principles of law, and the civil-constitutional methodology, as originally advocated by the Italian legal scholar Pietro Perlingieri. This analysis is justified by the practical relevance of the mechanisms of integration in hermeneutic activity. The objective of verifying eventual incompatibilities between the legal regime and the indicated method has been accomplished with the methodology of presenting recent decisions of the Superior Court of Justice in which the legal provision was expressly invoked, selected because they are considered illustrative of the application of the mechanisms integration to civil law issues. The results obtained are indicative of the contrast between the assumptions assumed by the legislator and those based on the civil-constitutional methodology.
