AFROCLUSION AND RACIAL EQUITY IN THE JUDICIARY

a critical analysis of CNJ Resolutions no. 203/2015 and no. 457/2022 as instruments of institutional reconfiguration

Abstract

The study analyzes policies promoting racial equality in the Brazilian judiciary, understanding them as part of an institutional effort to address the historical underrepresentation of the black population in decision-making and justice-making positions. The overall objective of the research is to examine how Resolutions No. 203/2015 and No. 457/2022 of the National Council of Justice act to combat Afro-exclusion, understood as a structural mechanism that prevents Black centrality in the justice system. The specific objectives are to identify the normative provisions set forth in these resolutions, understand the intended impacts of their application, and analyze how these measures convert criticism of racial exclusion into criteria for institutional reorganization. The research problem that guides the study consists of the following question: how do the resolutions of the National Council of Justice address Afro-exclusion and transform the presence of Black people into a structuring element of the Judiciary? The investigation uses a bibliographic methodology, with normative analysis and critical review of specialized literature. The results indicate that the resolutions not only expand the formal access of black people to public competitions and leadership positions, but also establish performance metrics and criteria that link institutional legitimacy to the promotion of racial diversity, confirming that these norms operate to transform the black presence and voice into structural components of the justice system and no longer as exceptional presences.
