GUARDIANSHIP AND PRODUCTION OF INCAPACITY IN ANALYSIS WITHIN THE FIELD OF MENTAL HEALTH

Abstract

This article analyzes guardianship and legal interdiction as legal mechanisms that, under the justification of protection, produce incapacity for people experiencing psychological distress by articulating medical and legal forms of knowledge sustained by the logic of the asylum model. Its objective is to problematize their effects on the production of subjectivities based on the experience of Therapeutic Accompaniment (TA). Methodologically, a genealogical-cartographic clinical approach was adopted, allowing the tracing of the historical constitution of guardianship and the mapping of its effects on everyday care practices. The findings indicate that, although contemporary legislation proposes the preservation of rights, in practice it operates by disauthorizing individuals in relation to their own desires. In contrast, Therapeutic Accompaniment proves to be a powerful practice for fostering autonomy, destabilizing the asylum logic. It is concluded that guardianship must be critically examined in light of its concrete effects and that care practices grounded in freedom and respect for human dignity should be strengthened.
