Abstract

The upraise of the Adivasi Studies during the last decades has been aiding their communities to uncover their demands and specificities. Nonetheless, the more visible they become as right subjects in the debates on their identities, indigenous identity and right to development, the Adivasis Peoples unfold the difficulty the juridical studies presents when it comes to incorporating complex forms of identities. In this article, we revise on the studies which take the Adivasis as their object. We come to the conclusion that those studies are part of a complex field that evolves from themes and methodology of other prominent scientific fields such as law, archeology, anthropology, agrarian history, environmental history, subaltern studies, indigenous studies, and development economy. In a second moment, contextualizing the state of those studies, we argue how the restructuring of the adivasi identity, departing from the indigenous rights subject, as defined in international law, seem to enable a greater correspondence between their cultural specificities and the language of the struggle for rights. Considering the defined themes and advances we could identify certain opportunities of including the cause of those communities in the struggle for rights language, although without standardization of the adivasis movement strategies according to the occidental standards. In this matter, their identity as indigenous peoples in the political debate allows the adequate addressing of their political, social and symbolical angst for recognition, their historical rights and their participation in the fundamental decisions of the common lives in their country.
