THE COMMUNITY PROTOCOL AS AN INSTRUMENT FOR PROTECTING AMAZONIAN TRADITIONAL RIVERSIDE COMMUNITIES: AN ANALYSIS OF THE BAILIQUE ARCHIPELAGO, AMAPÁ, BRASIL

The article examines the legal and political effectiveness of the Bailique Community Protocol (BCP) as a tool for safeguarding the territorial and socio-environmental rights of traditional riverside communities in the Bailique archipelago, Amapá, Brazil. The study employs a qualitative approach, based on document analysis and an interdisciplinary literature review that incorporates legal, social, and environmental dimensions. It aims to investigate the normative foundations of the PCB, its participatory structure, and the challenges faced in its institutionalization within the Brazilian legal framework. The findings reveal that, although the protocol represents progress in systematizing customary practices and affirming cultural and territorial rights, it presents technical weaknesses, deficits in popular participation, and lacks effective legal recognition. It is concluded that the hypothesis was partially confirmed: the protocol holds symbolic and political value, but lacks normative density and institutional backing to autonomously and effectively guarantee communities against external threats and systematic rights violations. This study contributes by highlighting the limits and potentialities of community-based normative instruments within the framework of socio-environmental justice in the Amazon.
