Abstract: Citizen inclusion and the realization of social fundamental rights are constitutional commitments that bind state powers and society. The family has special constitutional protection and must be to the protection of affections and the pursuit of the happiness of its members. The problem of the article focuses on the imposition of monogamy as a structuring principle of Family Law, by the theme 529 of the Supreme Court, which reflected the exclusion of fundamental rights for family entities constituted concurrently with marriage or stable union. For the execution of this article, bibliographical research was used, using the inductive method. It was concluded that the overcoming of majority moral values, in the context of private relations, with repercussions on Social Security Law, will materialize with the adoption of inclusive and feminist constitutionalism, and the application by the Judiciary of the Trial Protocol in the gender perspective of the National Council of Justice.
