Abstract

The free development of personality is an offshoot of the right to freedom, both to ensure respect for forms of expression and freedom to act according to one's will, allowing each person to choose their way of life, as long as it does not harm others. This right, even if not explicitly provided for, finds its constitutional foundation in the principle of human dignity, including the protection of difference and recognition of diversity in a society that seeks homogenization. Government intervention in this right must be carefully considered, and any restriction must respect the principle of proportionality so that the measure is appropriate, necessary, and proportionate to the desired end. The study aims to analyze the dimensions of the free development of personality and examine possible public interventions in this right, especially regarding restrictions. It concludes that creating an environment where human dignity is protected and individuality is respected is crucial for the healthy development of society while seeking to serve the public interest. The research employs the deductive method, based on bibliographical research, based on constitutional norms, and current legislation, as well as concepts presented by authors in books and specialized scientific journals.
