Abstract

Among the Sustainable Development Goals (SDGs), SDG No. 1 (“Eradicate poverty”) and SDG No. 13 (“Action against global climate change”) stand out, both because they represent the two main global problems, as well as because of their intrinsic relationship, so that the two agendas must be addressed in a coordinated manner by public policies. The general objective of this research is to analyze how poverty influences the fight against climate change in order to formulate a public climate policy consistent with the approach in which both poverty and climate impacts are seen as violations of fundamental rights and human rights in the Brazilian reality. The research is characterized as qualitative, with the documentary technique, through the use of government documents and reports and specialized literature. As a result, the study demonstrates the distortions created in Brazilian climate policy by disregarding the poverty eradication agenda and, on the other hand, presents legal arguments capable of justifying the indispensable union between SDG 1 and SDG 13 through an agenda to defend the rights of the most vulnerable populations.

Post-Doctoral Fellow at the René Rachou Institute, Fiocruz Minas Gerais in the Privaqua research group. Doctor in Social Sciences. PhD in Law and Development. CNPq Productivity Researcher, level 1D. Master in Sociology. Deputy Editor of Ambiente Sociedade. Specialist in Management of Public Organizations. Specialist in Business Law. Graduated in Legal Sciences. Collaborating professor of the Master's in Public Administration, permanent in the Master's in Management and Regulation of Water Resources, both at UFCG, permanent in the Master's in Regional Development, from UEPB and in the Postgraduate Program in Legal Sciences at UFPB, Master's and Doctorate. Pedro Curvello Saavedra Avzaradel, UNIVERSIDADE FEDERAL FLUMINENSE

É Pós-doutor em Direito Ambiental pela Universidade Paris I (2017) como parte do Programa CAPES/COFECUB tendo como instituição de fomento a CAPES. Doutor em Direito da Cidade pela Universidade do Estado do Rio de Janeiro (UERJ, 2012), Mestre em Sociologia e Direito pela Universidade Federal Fluminense (UFF, 2008) e Bacharel em Ciências Jurídicas e Sociais pela Universidade Federal do Rio de Janeiro (2005). Professor Adjunto da UFF desde 2014, lecionou entre este ano e o de 2022 no Campus de Volta Redonda as disciplinas Direito Ambiental, Direito Florestal, História do Direito e Sociologia Jurídica. Atualmente, leciona desde 2023 Direito Empresarial na Faculdade de Direito de Niterói. É membro fundador do Grupo de Estudos em Meio Ambiente e Direito, sendo um de seuslíderes entre os anos de 2014 e 2023 (https://gemadi.vr.uff.br). Integra desde 2015 o quadro permanente do Programa de Pós-Graduação em Direito Constitucional da mesma Universidade (PPGDC/UFF), lecionando disciplinas como A Questão Socioambiental no Constitucionalismo Latino Americano e Direito Constitucional Ambiental Ibero-americano.
