50 YEARS OF PACT OF SAN JOSE – COSTA RICA: REFLEXIONS ABOUT SOCIAL JUSTICE IN BRAZIL

The Pact of San Jose, also known as American Convention of Human Rights, it is named as a political and normative framework for the protection and promotion of Human Rights, especially in the Americas. In 2019 the Pact celebrates its 50th anniversary, when Brazil, as a signatory country to the document, must analyze the progress achieved and the remaining challenges, since it is understood that the realization of human rights demands a continuous process of resistance. . Through bibliographic and documentary research we aim to publicize the Pact's contributions to the construction of a theoretical and legal framework for the defense of human rights in Brazil, presenting the process of incorporation of the treaty into the national legal system, at the same time, seeking to assess whether the concept Justice System expressed in the preamble of the document finds space in the power structures established in Brazil.
