Abstract

The article discusses the risks faced by cultural rights in the 21st century, emphasizing the fragility of national and international public policies, as well as the impacts of globalization. The fragmentation of cultural initiatives and the lack of continuity in policies result in insufficient protection, especially for vulnerable communities. International treaties, such as those of UNESCO, often do not translate into concrete actions, leading to the marginalization of local cultures. Globalization promotes cultural homogenization, threatening diversity. To ensure the preservation of cultural rights, a collective commitment that involves effective public policies, cultural education and intercultural dialogue is essential. The research methodology included a bibliographic review of works by relevant authors in the area, analysis of existing regulations and public policies and case studies of communities affected by the lack of cultural protection. The research also considered data from international organizations on the implementation of cultural diversity treaties. In conclusion, cultural rights face significant transnational challenges that require an integrated and collaborative approach. Protecting cultural diversity is not just a matter of preservation, but of actively promoting cultural identities in a globalized world. It is imperative that governments, civil society and citizens work together to implement policies that guarantee access to and appreciation of cultural expressions, ensuring a diverse and inclusive future.
