Essential Services During Covid19 Pandemics: Challenges To Labour Law And Its Constitutional Principles

This article is dedicated to the analysis of the impact of the legislative changes implemented in the Brazilian labor legal system, in the first half of 2020, on the development of the working relationships of professionals linked to essential activities and services in the context of the pandemic COVID19. To this end, it is divided into two parts, the first being dedicated to the presentation of the main normative changes applicable to essential services and activities. Moreover, in the second half, a critical analysis is carried out, in the light of labor law and its constitutional principles, of said normative innovations and their impact on labor rights, and on a daily basis, of professionals of essential activities and services in full operation in the pandemic context. As a conclusion, it is stated that the interpretation and application of the aforementioned rules must be carried out in compliance with the constitutional protective labor principles of the working person, in particular that of the dignity of the human person. As an approach method, the inductive method was used, organized by research techniques of legislative and bibliographic analysis.
