Abstract

This experience report aims to analyze gender quota policies and the challenges for their consolidation as a fundamental human right for women's political participation. This consideration emerges from the professional practice of a feminist electoral lawyer and a gender and human rights researcher. It takes as reference the elections in the micro-regions of Paraíba, from 2020 to 2024, and the tensions that arise from this legislation’s application. In this scenario, potential reverse effects that could weaken the scope of quotas become evident, especially in light of the changes under debate in the New Electoral Code. This qualitative and empirical research is based on bibliographical research, judicial documents and parliamentary discourse. It is inferred that the effectiveness of gender quotas requires overcoming deeper institutional and cultural barriers, reinforcing the centrality of women as protagonists.

Electoral lawyer, academic director of IDEL/PB, member of the electoral law commission of OAB/PB, chaired the OAB's observatory on female candidates. Bachelor's degree in Law and Social Communication, postgraduate degree in Political Law and Electoral Practice, and currently pursuing a postgraduate degree in digital law. Lawyer active in the last five elections.

Isabella Arruda Pimentel, UnB

PhD candidate in the Graduate Program in Law at the University of Brasília (UnB), with ongoing research on Transitional Justice in Brazil, and Master's degree in Human Rights, Citizenship, and Public Policy from UFPB. Member of the research group on Theory and History of Human Rights and Democracy at UFPB and the research group on Transitional Justice at UnB.
