STATE OMISSION AND THE ROLE OF POPULAR ACTION IN THE DEFENSE OF HUMAN RIGHTS IN THE AMAZONIAN CONTEXT.

This research examines the underutilization of popular action as an instrument for defending human rights in the Paraense Amazon, investigating how the lack of legal-environmental education compromises its effectiveness. The central objective consists of analyzing how educational insufficiency conditions the perception and utilization of this constitutional mechanism, preventing its consolidation as a citizen response to structural violations of fundamental rights. Methodologically, qualitative research of basic nature was conducted, with hypothetical-deductive analysis, grounded in bibliographical and documentary research and empirical data collection from the PJe system of the Court of Justice of Pará State between 2002-2025. Results demonstrate that, of the 174 popular actions proceeding in Belém, only 8 are of environmental nature (4.6%), revealing a profound disconnection between the magnitude of socio-environmental problems and citizen legal mobilization. The research develops an analytical framework that articulates state omission as structural violation, popular action as potential citizen response, and legal-environmental education as effectiveness condition. A conceptual resignification of environmental popular action as an instrument for defending fundamental human rights is proposed. The study concludes that democratization of legal knowledge constitutes a fundamental strategy for revitalizing the instrument within the COP30 context, establishing citizenship infrastructure as a permanent educational legacy.
