Abstract

Homosexuals, unsatisfied or injured in face of the omission or neglect from the State (even from individuals) regarding the right to sexual orientation, have found the Judiciary as a place to eliminate the prejudices that victimize them. Then, is this view, hypothesis of affirmative protection by the Judiciary Power has recognized, mainly, their effective respect for freedom of sexual orientation, all under the constitutional foundation of human dignity.
