Brazilian prisons and violation of fundamental rights

This article aims to analyze the Brazilian prison system and the problems it faces, in light of the fundamental rights and guarantees provided for in the Federal Constitution. The research starts with the question: are fundamental rights being respected in prisons? Data from SISDEPEN and CNJ indicate that there are more than 650,000 prisoners in the country, in a scenario of overcrowding, unhealthiness and violation of rights. The methodology used was bibliographic research, based on legislation, official reports and authors in the legal and human rights fields. The results indicate that the Brazilian prison system violates principles such as human dignity and the right to physical integrity, requiring structural reforms and effective public policies.
